Fair Trials' letter to Birgit Sippel on the E-evidence Proposal

On 30 November 2018, Fair Trials wrote to MEP Birgit Sippel to urge the Members of the European Parliament to take into full consideration the implications of the Proposal for a Regulation of the European Parliament and of the Council on European production and preservation orders for electronic evidence in criminal matters (the “E-evidence Proposal”) on the right to a fair trial and for the LIBE Committee to request a working document on the impact of the E-evidence Proposal on defence rights.

It is essential that the E-evidence Proposal meets the requirements of the fundamental principle of equality of arms and ensures compliance with the procedural safeguards enshrined in the EU ‘Roadmap Directives’, which set common minimum standards in criminal proceedings including the right to interpretation and translation, the right to information, the right of access to a lawyer, the presumption of innocence and procedural safeguards for children who are suspects or accused persons in criminal proceedings. The Proposal is far from satisfactory since it contains only a passing reference to these procedural safeguards.
