Fair Trials' response to the European Commission's initiative to include hate speech and hate crime in the list of EU crimes

EU policy makers have committed to tackle harmful behaviours that profoundly affect our societies – such as crimes motivated by hate or gender-based violence – through increased criminalisation and harsher sentencing.

We believe that expanding the toolbox of law enforcement authorities is not an effective policy solution to achieve more inclusive societies; and are worried of the potential harm this can cause on the very communities it tries to protect. In this letter, we outline the main lines of our thinking.
