Short Update: Romania to conduct court proceedings via video conference

FairTrialsAdmin - March 30, 2020 - COVID-19 Updates, Remote Justice

With Romania’s courts closed for all but the most urgent cases, courts are now conducting hearings via video conference where this is possible. Official court documents are also being provided by fax, email or other remote means (provided that they provide confirmation that the document has been sent and received).

Videoconferencing is now in use for accused held in pre-trial detention. This takes place from the place of detention and does not require the agreement of the detainee.

Romanian NGO, APADOR-CH (https://www.apador.org/en/) has discussed these changes with defence lawyers who reported that, after initial challenges, video conferencing is now considered to be proving useful and effective in many cases. There have, however, been some logistical impediments. For example, in cases with several defendants, there is insufficient space to ensure a distance of 2m between defendants so they are being heard separately.
