Short Update: Rhineland-Palatinate Association of Judges promotes video hearings in certain criminal proceedings because of COVID-19

FairTrialsAdmin - April 30, 2020 - COVID-19 Updates, Remote Justice, Access to a lawyer

Judges in Rhineland-Palatinate have suggested the introduction of video hearings for certain criminal proceedings because of COVID-19. During these video hearings, the judge would be in the courtroom and the parties involved would be connected via service providers such as Skype.

These proceedings have been suggested for administrative offence proceedings, such as a hearing on an appeal against a fine. Given that the German Code of Criminal Procedure ("Strafprozessordnung") does not contain any provision that would allow a criminal trials to be conducted by video, the Rhineland-Palatine Association of Judges have called for the law to be amended suggests an amendment to the law.
