Short Update: Poland introduces as a minor offence failing to comply with the instructions of the police or city guard

FairTrialsAdmin - April 16, 2020 - COVID-19 Updates, New criminal offences

A new offence was added to the Polish Minor Offences Code, specifying that anyone who, by failing to comply with instructions lawfully given by an officer of the police or city guard to behave in a certain way, intentionally prevents or considerably hinders the performance of official duties, will be liable to detention, restriction of liberty or a fine.

The proposal has no connection with the epidemic, it is merely the implementation of the petition of the Management Board of the trade union of police officers in August 2019 to enable the detention of persons who fail to comply with any instructions given by an officer of the police or city guard.
