Short Update: The Madrid High Court has denied the ratification of further “Covid measures” on fundamental rights grounds

FairTrialsAdmin - October 9, 2020 - COVID-19 Updates, New criminal offences, Rule of Law

The Madrid High Court has refused to ratify further localised COVID-19 restrictions on the Spanish capital which would have prohibited non-essential travel, limited social gatherings and introduced a 50% rule on public indoor spaces.

Following disagreement between regional and central authorities, the High Court ultimately deemed the proposed restrictions unlawful, on the basis that they would impinge residents’ fundamental rights.
