Short Update: England’s test and trace programme breaks data protection law

England’s test and trace programme has broken data protection law, under the General Data Protection Regulation, by failing to carry out the required assessment of the scheme’s impact before its launch. 

The test and trace programme involves people being asked to share their personal data, including: 

  • their name, date of birth and postcode; 

  • who they live with; 

  • places they recently visited; and 

  • names and contact details of people they have recently been in close contact with, including sexual partners.  

Privacy campaigners Open Rights Group challenged the government on its failure to carry out the legally required “Data Protection Impact Assessment’, to assess how the impact of the data collection by the programme. The group said that this failure means that the scheme has been unlawful since it launched on 28th May.
