Short Update: Dutch district courts no longer limiting hearings to urgent criminal cases only, but without presence of defendant

After initially limiting hearings to ‘urgent cases’, since 8 April, various district courts (including Gelderland and Overijssel) in the Netherlands are expanding the types of criminal cases they will hear. For now, this includes decisions on the extension of detention under hospital order (TBS).   

At these hearings, the judge, public prosecutor(s) and attorney(s) may be physically present at the hearing, although the defendant will attend via video conferencing. For the parties who will be physically present, the courts have taken measures to ensure that all persons can remain at a 1.5 metre distance from each other.  

The public is not allowed to attend. If requested, a limited number of journalists may be allowed to attend remotely via Skype.
