In spite of instructions issued by the Madrid Superior Court (see our update here), police stations in Madrid are adopting different approaches to remote justice. Police stations don´t have the resources to organise videoconferences with lawyers, and lawyers continue to attend police questioning in person. However, detainees are not always kept at a safe distance or provided with gloves and masks.
Regarding court proceedings, courts are continuing to hold hearings (including on pre-trial detention) with the physical presence of judges, judicial staff, civil servants, prosecutors and lawyers, but not with the presence of the detainee. Lawyers have filed today a complaint to the Superior Court of Madrid, asking the court give instructions to regional courts to stop this practice.
