Short Update: Belgium suspends extradition to Spain due to COVID-19 crisis

On 24 March 2020, the Brussels court of first instance suspended the execution of a European Arrest Warrant issued by the Spanish authorities. The requested person was not being held in custody in Belgium. As a result of the new “COVID19 crisis” rules suspending proceedings that do not involve detention, the request for extradition was not considered to be urgent and the EAW proceedings were suspended.

The court also questioned the necessity or usefulness of a transfer to Spain where, according to publicly available sources, the consequences of contamination are considerably worse than in Belgium.
