Short Update: Albania introduces new criminal offences raising concerns

The Albanian government has amended the Criminal Code introducing to new criminal offenses of: 

  • Failure to implement the measures of the state authorities during the state of emergency or during the state of epidemic, is punishable by initially a fine from 50.000 ALL to 3.000.000 ALL (400 euro to 24.000 euro). Similar offences committed in exercise of commercial activity or by putting human health at risk and violations of quarantine or isolation orders is punishable by a fine or imprisonment for up to 2 years. 

  • The spread of infectious diseases is punishable by a fine or imprisonment of up to two years or by a fine or imprisonment of three to eight years.  

Albanian Rule of Law Centre has expressed concerns that these new criminal offenses are used to prevent people from using the right to assembly to protest government measures. These offences and other restrictions on human rights are issued by administrative orders of the Minister of Health and raise concerns as to their proportionality.  

The Albanian Rule of Law Centre and many other lawyers have started a public campaign demanding observance of constitutionality, rule of law and human rights in general, and particularly the right to a fair trial in Albania.
