Growing Prosecutorial Power in Europe's Criminal Legal Systems

Thursday, 4 Mar 2021 14:00 - 15:15 CET

Online

Over the last decades, scholars have noted the growing or shifting power of prosecutors in Europe's criminal legal systems. They have suggested that "overloaded" criminal justice system, a lack of prosecutorial independence, and a general shift towards an accusatorial system have all contributed.

From shaping how much information defence attorneys have—including to assist their clients to avoid pre-trial detention—to determining the procedural course of a case, including whether a person gets a trial at all—prosecutors have considerable power. We will consider the broad trends in Europe and focus our attention on trial waivers and access to investigatory information. These discussions are timely as 2021 marks the introduction of the European Public Prosecutor's Office.

Speakers:

  • Laure Baudrihaye-Gérard, Fair Trials (moderator)
  • Marianne Wade, University of Birmingham
  • Aurélia Grignon, Soulez Lariviere Avocats
  • Jacqueline Hodgson, University of Warwick

This event is a public panel as part of our 2021 Legal Experts Advisory Panel (LEAP) Annual Conference: Power and Punishment in Europe. LEAP is Fair Trials’ European network of experts in criminal justice and human rights which works to promote fair trial rights in Europe. LEAP currently counts some 200 organisational members, with representatives from law firms, CSOs, and academic institutions, covering all 27 EU Member States.
