Fair Trials’ response to the European Commission call for evidence
Fair Trials has submitted input to the European Commission’s call for evidence on an initiative addressing shortcomings in the European Investigation Order (EIO) and establishing common rules on remote participation in criminal proceedings. Our submission stresses that any expansion of remote hearings or reform of the European Investigation Order must be firmly grounded in fair trial rights, not driven by efficiency alone. In particular, we emphasise that informed consent, effective participation, confidential access to lawyers, and meaningful remedies to challenge cross-border evidence are essential safeguards.
As cross-border criminal cooperation continues to grow, EU rules must ensure that fundamental rights remain the foundation of mutual trust.
