Westminster Magistrates' Court, Court in Mures (Romania) v Zagrean

August 2016 - United Kingdom

The Westminster Magistrate’s Court refused to execute an EAW issued by Romania as a result of the evidence assessed in the case of Daniel Nicolae Rusu (cited above). The Court found that the Romanian authorities were unable to honour the assurances given to British Courts that prisoners extradited from the UK would not be subjected to poor prison conditions that would impair their rights under Article 3 of the ECHR.
