Short Update: Dutch courts suspends pre-trial detention due to health risk concerns

FairTrialsAdmin - April 6, 2020 - COVID-19 Updates, Delayed or accelerated proceedings

In two decisions of 19 March on pre-trial detention, the District Court of the County North-Holland took into account the health of the suspect and his family, as well as the risk of prolonged detention to the delays in criminal investigations, to suspend pre-trial detention. One suspect (aged 67) was in a vulnerable health state, and the other had fragile parents. Both suspects were released on conditional bail. In both decisions, the court attached weight to the position of the public prosecutor, who did not oppose the requested suspensions. See here and here for the decisions.
